EPCFire.com, operated by Initiative Ventures LTD
1. About These Terms
1.1 These Terms of Service ("Terms") govern your purchase and use of any software application, digital product or training resource ("Product") sold through EPCFire.com, including TBB Marketing Research & Planning Software.
1.2 The Products are provided by Initiative Ventures LTD, a company registered in England and Wales, trading as EPCFire.com ("we", "us", "our"). Our registered address is 3 Catherine Wheel Mews, High Street, Southampton, SO30 2EA, United Kingdom. Company number: 12284983.
1.3 By purchasing or using a Product, you agree to these Terms. If you don't agree, please don't purchase or use our Products.
1.4 These Terms should be read alongside our Privacy Policy, Refund Policy and Results Disclaimer, which form part of these Terms.
2. Products, Payment and Access
2.1 Our Products are software applications and training resources for digital marketing research, content preparation and campaign planning. Each product page describes the features, access options and price before you buy.
2.2 Our Products don't sell, send or deliver customers, website visitors, advertising clicks, leads, followers or engagement.
2.3 Unless a product page clearly says otherwise, all purchases are one-time payments. We don't charge automatic recurring subscription fees.
2.4 Payments are processed securely by Stripe. We don't store your full card details.
2.5 Prices are shown in US dollars at checkout. Any applicable taxes are shown before you complete payment.
2.6 Charges appear on your card statement as EPCFIRE.COM.
2.7 After a successful payment, you'll receive access details by email, usually within a few minutes. If you haven't received access within 24 hours, please contact support.
2.8 Your contract with us is formed when we send your access details.
3. Refunds and Your Rights
3.1 Unless a product page clearly states otherwise, eligible purchases are covered by our 30-day money-back guarantee. To request a refund, contact support within 30 days of purchase. Full details are in our Refund Policy.
3.2 Because our Products are digital and supplied immediately, you agree at checkout that access starts straight away. Our 30-day money-back guarantee applies in addition to, and doesn't reduce, your legal rights.
3.3 If you're a consumer, nothing in these Terms affects your statutory rights, including your rights under the Consumer Rights Act 2015 for digital content that is faulty or not as described.
3.4 If you have a problem with a purchase, please contact us before raising a dispute with your bank or card provider. We'll aim to resolve it quickly.
4. Licence, Accounts and Acceptable Use
4.1 When you buy a Product, we grant you a personal, non-exclusive, non-transferable licence to use it for your own business or personal purposes, within the access level you purchased.
4.2 You may not resell, share, sublicense or give others access to a Product or your login details unless the product page expressly allows it.
4.3 You're responsible for keeping your login details secure and for all activity under your account.
4.4 You agree not to use our Products to:
- break any law or regulation, including marketing, privacy and consumer protection laws;
- send spam or unsolicited messages;
- create misleading, deceptive or fraudulent content;
- infringe anyone else's intellectual property or other rights;
- break the rules of any platform where you use material created with our Products;
- attempt to copy, reverse engineer, disrupt or gain unauthorised access to our software.
4.5 You're solely responsible for any content you publish and any marketing activity you carry out using our Products.
5. AI-Generated Content and No Guarantee of Results
5.1 Our software uses artificial intelligence to produce research suggestions, marketing content and campaign plans. AI output can be inaccurate, incomplete or unsuitable for your purpose.
5.2 You must review all generated material for accuracy, suitability and compliance with applicable laws and platform rules before you use it.
5.3 Our Products are research, planning and training tools. We don't guarantee website traffic, audience engagement, leads, customers, sales or any other commercial result.
5.4 Any examples on our website are for illustration only and aren't a promise of what you'll achieve. Your results depend on your own decisions, skills, effort and circumstances. See our Results Disclaimer.
5.5 Our Products don't provide legal, financial, tax or other professional advice.
6. Intellectual Property, Availability and Changes
6.1 We own, or are licensed to use, all intellectual property in our Products, software, website and materials. Your licence doesn't transfer any ownership to you.
6.2 Subject to these Terms and the rules of any AI provider we use, you may use the content you create with our Products for your own lawful purposes.
6.3 We aim to keep our Products available, but we don't guarantee uninterrupted or error-free access. We may carry out maintenance, updates or improvements from time to time.
6.4 Some features rely on third-party services, such as AI providers. If a third-party service changes or becomes unavailable, we may need to change or replace a feature. If a change significantly reduces what you paid for, contact us and we'll discuss a fair solution, which may include a refund.
6.5 We may update these Terms from time to time. The version in force when you make a purchase applies to that purchase. The date at the top shows when these Terms were last updated.
7. Liability, Termination, Law and Contact
7.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that can't be limited or excluded by law.
7.2 Subject to clause 7.1, we aren't liable for any loss of profit, revenue, business, data or opportunity, or for any indirect or consequential loss, arising from your use of our Products or any content created with them.
7.3 Subject to clause 7.1, our total liability to you in connection with any Product is limited to the amount you paid for that Product.
7.4 We may suspend or end your access to a Product if you seriously or repeatedly break these Terms, including the acceptable use rules in section 4. Where reasonable, we'll tell you first and give you a chance to fix the problem.
7.5 These Terms are governed by the law of England and Wales. If you're a consumer living elsewhere in the UK, you may also bring proceedings in your local courts.
7.6 If any part of these Terms is found to be unenforceable, the rest will still apply.
